Terms & Conditions
This agreement outlines your obligations as a member and explains our obligations to you.
By enrolling as an Easy Lolly member you agree to the following terms and conditions:
1. Site Membership and Termination of Accounts
Easy Lolly only allows one account per person. You must be over 18 and a resident of the UK to qualify for an Easy Lolly account and receive cashback.
We reserve the right to refuse membership. Further, we reserve the right to terminate your Easy Lolly account without notice at any time. Any cashback held in the account, or paid after termination, is forfeit. Accounts will also be deleted where an invalid/temporary e-mail address is provided e.g. mailinator, sogetthis, fakeinformation.com etc.
2. Cashback Rewards
As an Easy Lolly member, you will earn a percentage 'cashback', or cash reward from a number of retailers as illustrated on the Easy Lolly member's website.
We will make every effort to ensure cashback offers are correctly illustrated.
It's important to note that all transactions you make are not with us, but the individual retailer.
Your Easy Lolly account will only be credited when the retailer confirms your transaction. Sometimes this happens immediately, although often our retailer's process transactions when their returns policy date has expired (this can be 30 days or more).
Should the goods be refunded, or the sale otherwise reversed, then the cashback payment will not be made.
Cashback rewards can only be paid when an Easy Lolly member has logged into the site and accessed the retailer's site via a link from the member's area.
All transactions are electronically logged and reported back by the retailer. Easy Lolly will make every effort to ensure that retailer's are correctly reporting cashback sales; however we cannot be held responsible should the retailers systems fail to report back your sale. (In the rare case that this occurs we will make every effort to negotiate the cashback reward from the retailer on your behalf; however the retailer's decision is final).
3. Payment Schedule
The member may request a payment be made to them at any time, subject to their account balance being at least
£25. Payment will be issued subject to the commission having been received from the respective merchant/s. Should a retailer delay payment or cease trading, then we will make every effort to recover your cashback; however Easy Lolly makes no guarantees to payment until funds have been received from the retailer or their agents.
4. Members Newsletter
All members will receive a regular newsletter, providing updates on the latest Easy Lolly member's offers and site updates. It is a condition of membership that you provide and maintain a valid email address to receive this weekly email.
NB. As per our privacy policy your email address will not be sold or shared or rented to a third party.
5. Dormant Accounts
In the event that your Easy Lolly account is dormant (showing no transactions) for a period exceeding 12 months
then the account will be considered void and
will be closed and all unpaid rewards will be forfeit.
6. Modification of Agreement
We may modify any of the terms and conditions contained in this Agreement, at any time and in our sole discretion by posting a revised agreement on the Easy Lolly website.
7. Miscellaneous
This Agreement will be governed by the laws of the United Kingdom, without reference to rules governing choice of laws.
Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.
8. No Warranties
The service and all materials available through the service, are provided to you "as is," "with all faults," and "as available." we, our affiliates, agents and licensors cannot and do not warrant the accuracy, completeness, currentness, non-infringement, merchantability or fitness for a particular purpose of the service or any information or materials available through the service, nor do we guarantee that the service or materials or information available through the service will be error-free, or continuously available, or free of viruses or other harmful components.
9. Limitations on Our Liability
Under no circumstances shall we, or our affiliates, agents or licensors be liable to you or anyone else for any damages arising out of use of the service or any information or materials available through the service, including, without limitation, liability for consequential, special, incidental, indirect, or similar damages, even if we are advised beforehand of the possibility of such damages. You agree that our liability and the liability of our affiliates, agents and licensors, if any, arising out of any kind of legal claim in any way connected to the service shall not exceed the amount you paid for the use of the service.
We cannot guarantee or warrant that the Service or materials that may be downloaded from the Service do not contain viruses, worms, "Trojan horses," or other destructive features. If you download any files from the Service, you do so at your own risk.
